Customer understands and agrees that loading, unloading, entering, exiting, climbing into, walking inside, standing near, opening, closing, securing, or otherwise using a dumpster involves inherent risks, including but not limited to slips, trips, falls, cuts, strains, falling debris, shifting materials, sharp objects, unstable footing, uneven ground, pinching/crushing hazards, and injury from the dumpster door, latch, hinges, or swinging door movement.

Customer is solely responsible for the safe use, loading, and supervision of the dumpster during the rental period. Customer agrees that only responsible adults age 18 or older may open, close, enter, exit, load, or otherwise use the dumpster. Customer shall not permit children, minors, guests, invitees, neighbors, contractors, employees, or any unauthorized person to play in, climb on, enter, operate, or misuse the dumpster.

Customer agrees to use reasonable care at all times and shall not climb over the dumpster walls, jump into or out of the dumpster, stand on the sides or door, overload the dumpster, load above the fill line, load prohibited materials, create unsafe weight distribution, or use the dumpster in any manner that may create a hazard. Customer is responsible for ensuring that the dumpster door is opened and closed carefully, that all persons remain clear of the swing path of the door, and that the door is properly secured before loading or while the dumpster is in use. Customer shall immediately stop using the dumpster and contact Junk Wranglers and Removal LLC if Customer believes the dumpster, door, latch, placement area, or surrounding conditions are unsafe.

Customer voluntarily assumes all risks of injury, property damage, loss, claims, or expenses arising out of or related to Customer’s use, loading, unloading, entry into, exit from, or operation of the dumpster, including use by Customer’s family members, guests, invitees, contractors, employees, agents, or any other person accessing the dumpster during the rental period.

To the fullest extent permitted by law, Customer releases, waives, and agrees not to bring any claim against Junk Wranglers and Removal LLC, its owner, members, managers, officers, employees, contractors, agents, insurers, successors, and assigns for injuries, damages, losses, claims, demands, costs, or expenses arising out of or related to Customer’s use, loading, unloading, entry into, exit from, operation, supervision, or misuse of the dumpster, including but not limited to falls, door-related injuries, loading injuries, cuts, pinching/crushing injuries, falling debris, shifting materials, or unsafe site conditions, except to the extent such injury or damage is caused by the gross negligence, willful misconduct, or intentional misconduct of Junk Wranglers and Removal LLC.

Customer further agrees to defend, indemnify, and hold harmless Junk Wranglers and Removal LLC, its owner, members, managers, officers, employees, contractors, agents, insurers, successors, and assigns from and against any and all claims, lawsuits, damages, injuries, losses, liabilities, fines, penalties, costs, and expenses, including reasonable attorney’s fees, arising out of or related to: Customer’s breach of this Agreement; Customer’s unsafe loading or use of the dumpster; Customer’s failure to follow safety instructions; Customer’s overloading or improper loading of the dumpster; Customer’s placement of prohibited materials in the dumpster; injury or damage caused by Customer, Customer’s family members, guests, invitees, contractors, employees, agents, or any person accessing the dumpster during the rental period; or unsafe conditions at the rental site not caused solely by Junk Wranglers and Removal LLC.

Customer acknowledges that Customer has read, understands, and voluntarily agrees to this section before delivery and use of the dumpster.
